General Terms and Conditions of EXPERIMINTA gGmbH for visiting the EXPERIMINTA ScienceCenter

1. GENERAL - DEFINITIONS

1.1 The following General Terms and Conditions (hereinafter referred to as GTC) shall apply to the visit of the EXPERIMINTA ScienceCenter between the contracting party (hereinafter referred to as contracting party) and EXPERIMINTA gGmbH, Hamburger Allee 22-24, 60486 Frankfurt am Main (hereinafter referred to as EXPERIMINTA).

1.2 The following GTC shall apply exclusively. Any terms and conditions of the contracting party that conflict with or deviate from these GTC shall not be recognized unless EXPERIMINTA expressly agrees to their application in writing or in text form or the contracting parties agree otherwise.

1.3 The contracting party within the meaning of these GTC shall be the person who purchases one or more admission ticket(s) for visiting the EXPERIMINTA ScienceCenter for himself/herself and/or third parties (participants) from EXPERIMINTA or books a service that includes admission to the ScienceCenter.

1.4 Participants within the meaning of these GTC are all third parties who - without being contractual partners - are entitled to enter the ScienceCenter.

1.5 Visitors within the meaning of these GTC are the contracting party and/or participants individually or together.

1.6 The contractual partner shall ensure that the participants are familiar with these GTC and comply with the rights and obligations arising therefrom.

1.7 The following GTC shall govern the entitlement to enter EXPERIMINTA and, in particular, to visit the exhibition and use the experimental stations located therein, the special exhibitions, the science shows, and the public events.

1.8 For workshops, children's birthday parties and vacation camps, supplementary GTCs shall apply in each case.

1.9 Terms used in these GTC are gender-neutral.

 

2. ADMISSION PRICES - CONCLUSION OF CONTRACT

2.1 The admission prices for visiting EXPERIMINTA shall apply in accordance with EXPERIMINTA's List of Prices and Services. All admission prices include the statutory value-added tax applicable at the time.

2.2 The contract shall be concluded following the offer made by the Contractual Partner through acceptance by EXPERIMINTA. The contracting party shall be obliged to perform in advance.

2.3 The following shall apply to orders placed via the online booking form:

2.3.1 The Contractual Partner may submit the offer to conclude a contract for visiting EXPERIMINTA via the online booking form provided on EXPERIMINTA's website. The contracting party may complete this form on the website www.experiminta.de/en/groups. In doing so, the contracting party, after entering its order data (in particular the number of participants) in the form, submits a legally binding contractual offer with regard to the selected offer and the associated services by clicking on the "Reserve now" button that concludes the booking process.
However, the offer to conclude the contract by the contractual partner can only be made by him if he accepts the inclusion of these GTC in the contract and confirms this with a corresponding click. This process takes place before clicking the button "Reserve now" which concludes the booking process.
The booking process can only be completed in this way.

2.3.2 EXPERIMINTA may accept the Contractual Partner's offer pursuant to Clause 2.3.1,
- by sending the contracting party an order confirmation in text form (fax or e-mail) within 7 calendar days of receipt of the offer, in which case the date of receipt of the order confirmation by the contracting party shall be decisive, or
- by requesting payment from the contracting party after the latter has submitted its offer.
If EXPERIMINTA does not accept the contracting party's offer within 7 calendar days, this shall be deemed to be a rejection of the offer with the consequence that the contracting party shall no longer be bound by its declaration of intent.

2.3.3 Before binding submission of the offer via the online booking form, the contracting party may continuously correct its entries using the usual keyboard and mouse functions. Before clicking the "Reserve now" button, the contract partner also has the option of deleting entries as well as the option to cancel the booking process altogether.

2.3.4 The contract is concluded in German. This page is just a translation of the German General Terms and Conditions of EXPERIMINTA gGmbH. In case of doubt, the German version applies.

2.3.5 The Contractual Partner shall be informed of the payment options. EXPERIMINTA currently offers the following payment options: Bank transfer (advance payment), payment at the cash desk in cash, by ec card or credit card.

2.3.6 Booking processing and contacting shall generally take place via e-mail and automated booking processing. The Contractual Partner shall ensure that the e-mail address provided by it for booking processing is accurate, so that e-mails sent by EXPERIMINTA can be received at this address. In particular, when using SPAM filters, the contracting party shall ensure that all e-mails sent by EXPERIMINTA or by third parties commissioned by EXPERIMINTA to handle bookings can be delivered.

 

3. AGE LIMIT - NO SUPERVISION

3.1 Children under the age of 12 may only visit EXPERIMINTA if accompanied by a parent or guardian or a supervisor of full age. EXPERIMINTA shall be entitled to request the age of the contracting party or participant prior to admission for the purpose of verifying this age limit.

3.2 EXPERIMINTA shall not be responsible for the supervision of visitors during their visit to EXPERIMINTA.

 

4. WITHDRAWAL BY EXPERIMINTA

4.1 EXPERIMINTA shall be entitled to withdraw from the contract with immediate effect in the event of a case of force majeure that makes it impossible, in whole or in part, to provide the service selected by the contracting party. The same shall apply in the event that the visit has to be prohibited for safety reasons, due to technical malfunctions or other circumstances for which EXPERIMINTA is not responsible.

4.2 In the event of a withdrawal pursuant to Section 4.1, the fee paid by the contracting party shall be refunded. The fee shall be refunded by the same means of payment by which it was paid. Any further claims are expressly excluded.

 

5. LIABILITY

5.1 The stay on the premises and in the buildings of EXPERIMINTA shall be at the Contractual Partner's own risk.

5.2 Any claims for damages on the part of the Contractual Partner shall be excluded. Excluded from this are claims for damages by the contracting party arising from injury to life, body, health or from the breach of essential contractual obligations (cardinal obligations) as well as liability for other damages based on an intentional or grossly negligent breach of duty by EXPERIMINTA, its legal representatives or vicarious agents. Material contractual obligations are those whose fulfillment is necessary to achieve the objective of the contract.

5.3 In the event of a breach of material contractual obligations, EXPERIMINTA shall only be liable for the foreseeable damage typical for the contract if such damage was caused by simple negligence, unless the contracting party's claims for damages are based on injury to life, body or health.

5.4 All exclusions and limitations of liability under this Clause 5 shall also apply in favor of EXPERIMINTA's legal representatives and vicarious agents if claims are asserted directly against them.

 

6. DATA PROTECTION CLAUSE

6.1 EXPERIMINTA shall be the responsible party within the meaning of data protection law. The contracting party's personal data shall be processed by EXPERIMINTA solely for the purpose of fulfilling the contract (pursuant to Article 6 (1) sentence 1 letter b of the General Data Protection Regulation of 27.04.2016).
Data will only be transferred to other third parties if this is necessary for the performance of the contract or EXPERIMINTA is legally obliged to do so. Any use beyond this requires legal permission or the consent of the contractual partner. Data shall not be transferred to a third country.

6.2 EXPERIMINTA shall not use the Contractual Partner's personal data for purposes of advertising or market or opinion research.

6.3 Reference is made to the privacy policy of EXPERIMINTA gGmbH.

 

7. FINAL PROVISIONS - HOUSE RULES - NO RIGHT OF REVOCATION - PLACE OF JURISDICTION - APPLICABLE LAW

7.1 The house rules of EXPERIMINTA shall apply in addition. Contractual partners and participants shall together be referred to in the house rules as "visitors". Visitors who violate the house rules may be expelled from EXPERIMINTA. The contracting party shall ensure - insofar as this is reasonable for it - that participants observe the house rules.

7.2 There is no statutory right of revocation for the booking of admission tickets to visit EXPERIMINTA due to the provision in Section 312g (2) (9) of the German Civil Code (BGB).

7.3 If the contractual partner is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from the contract on the visit to EXPERIMINTA shall be the court responsible for the registered office of EXPERIMINTA gGmbH in 60486 Frankfurt am Main, Germany.

7.4 The law of the Federal Republic of Germany shall apply.
However, this choice of law shall only apply to the extent that it does not deprive the consumer of mandatory applicable consumer protection provisions of the state in which the consumer has his or her voluntary residence at the time of the conclusion of the contract on the visit to EXPERIMINTA.

7.5 Information on online dispute resolution: The EU Commission provides a platform for the online settlement of disputes (so-called "OS platform") on the Internet. The ODR platform is intended to serve as a contact point for the out-of-court settlement of disputes concerning contractual obligations arising from online purchase contracts or online service contracts. The ODR platform can be accessed at the following link: http://ec.europa.eu/consumers/odr
EXPERIMINTA gGmbH is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

General Terms and Conditions of EXPERIMINTA gGmbH for Children's Birthday Parties

1. Scope of Application - Validity

1.1 These General Terms and Conditions (hereinafter referred to as "GTC") as amended from time to time shall apply to all children's birthday parties (hereinafter referred to as "Birthday Parties") organized by EXPERIMINTA gGmbH (hereinafter referred to as "Organizer"), Hamburger Allee 22-24, 60486 Frankfurt, Germany, and shall govern the legal relationship arising between the contracting party (hereinafter referred to as "Contracting Party") and the Organizer.

1.2 The contractual partner within the meaning of these GTC is the person who books a birthday party with the organizer for himself and/or third persons (participants).

1.3 Participants in the sense of these GTC are all third persons who - without being contractual partners - are entitled to participate.

1.4 Visitors in the sense of these GTC are contractual partners and/or participants individually or together.

1.5 The GTC are subject to occasional changes in content. They are part of the contract between the organizer and the contractual partner in the version valid at the time of registration.

1.6 All declarations by a contractual partner vis-à-vis the event organizer shall be made in writing to EXPERIMINTA gGmbH, Hamburger Allee 22-24, 60486 Frankfurt, Germany, via geburtstage@experiminta.de.

1.7 Terms used in these GTC are gender-neutral.

 

2. Conditions of Participation

2.1 A minimum age must be met in order to be eligible to participate.

2.2 All organizational measures to be observed by the visitors shall be announced by the organizer to the contractual partner in due time before the beginning of the respective birthday. The announcement shall be made either on the website of the Organizer, by e-mail to the Contractual Partner or directly on site on the day of the respective event.

2.3 The instructions of the organizer and his staff must be followed during the birthday party. In case of any infringement that may disturb the orderly course of the birthday party or endanger the safety of the visitors, the organizer is entitled to pronounce the exclusion of the respective visitor from the event at any time or to cancel the birthday party. There is no right to a refund of the paid amount.

2.4 Children under 12 years of age may participate in a birthday party only if accompanied by a parent or guardian or an adult supervisor. The organizer is entitled to request the age of the contracting party or participant before admission for the purpose of verifying this age limit.

2.5 The Organizer shall not assume the supervision of the visitors for the duration of the birthday. For this purpose, each birthday party must be accompanied by at least two adult supervisors.

 

3. Registration - Participant fee - Terms of payment - Cancellation

3.1 By registering for a birthday party, the contractual partner offers to conclude a contract with the organizer. The registration of a birthday party shall be made via an online form provided. It shall also be made for all participants listed in the registration, for whose contractual obligations the registering party shall be liable as for its own obligations. Only after a written confirmation of the registration by the organizer, the birthday is bindingly booked for the contract partner. By registering, the Contractual Partner accepts the General Terms and Conditions of the Organizer.

3.2 For the order via the online booking form applies:

3.2.1 The Contractual Partner may submit the offer to conclude a contract for booking a birthday via the online booking form provided on the website of the Organizer. The contracting party can fill out this form on the website www.experiminta.de/en/childrens-birthdays. In doing so, the contractual partner, after entering his order data in the form, submits a legally binding contractual offer with regard to the selected offer and the associated services by clicking the button "Book your birthday" which concludes the booking process.
However, the offer to conclude the contract by the contractual partner can only be made by him if he accepts the inclusion of these GTC in the contract and confirms this with a corresponding click. This process takes place before clicking the "Book your birthday" button that concludes the booking process.
The booking process can only be completed in this way.

3.2.2 The organizer can accept the offer of the contract partner according to section 3.2.1,
- by sending the contract partner an order confirmation in text form (fax or e-mail) within 7 calendar days of receipt of the offer, whereby the receipt of the order confirmation by the contract partner is decisive, or
- by requesting payment from the contract partner after the offer has been submitted.
If the organizer does not accept the contract partner's offer within 7 calendar days, this shall be deemed to be a rejection of the offer with the consequence that the contract partner shall no longer be bound by its declaration of intent.

3.2.3 Prior to the binding submission of the offer via the online booking form, the contracting party may continuously correct its entries using the usual keyboard and mouse functions. Before clicking the "Book your Birthday" button, the contract partner also has the option to delete entries as well as the option to cancel the booking process altogether.

3.3 The prices for booking a birthday party shall apply in accordance with the Organizer's list of prices and services. All prices include the applicable statutory value-added tax.

3.4 The contract shall be concluded after the offer of the Contractual Partner by the acceptance of the Organizer. The contractual partner is obliged to perform in advance.

3.5 Booking processing and contacting usually take place by e-mail and automated booking processing. The contract partner must ensure that the e-mail address provided by him for booking processing is correct so that e-mails sent by the organizer can be received at this address. In particular, when using SPAM filters, the contract partner must ensure that all e-mails sent by the organizer or by third parties commissioned by the organizer to process the booking can be delivered.

3.6 The contract partner can withdraw from the birthday at any time. The withdrawal can only be declared in writing to the address mentioned under point 1.6. If the contract partner withdraws from the contract or does not take up the offer, the provider can demand lump-sum withdrawal costs in accordance with § 651 i paragraph 2 BGB (German Civil Code) as reasonable compensation for precautions taken and for its expenses. The amount of the cancellation costs for canceled birthdays depends on the receipt of the cancellation. Cancellations must always be made in writing (email or mail). These flat-rate cancellation costs are per registered birthday:

  • Up to 2 weeks before the start of the event: free of charge
  • from 2 weeks before the start of the event: 100% of the fee
  • in case of unexcused absence: 100% of the fee

If the event is cancelled prematurely due to various reasons (e.g. illness, injury), no costs can be refunded.

 

4. Exclusion of liability

4.1 Should the organizer be obliged to make changes to the implementation of the event or to cancel it due to force majeure or corresponding official orders or for safety reasons, the contractual partner shall have no claim to reimbursement of the participation fee.

4.2 The organizer is not liable for property damage and financial losses, unless these have been caused by gross negligence or intent. Excluded from this limitation of liability are damages based on the culpable violation of a main contractual obligation of the organizer as well as for culpably caused personal injuries (injuries to life, body or health of a visitor). The aforementioned limitations of liability also extend to the personal liability for damages of employees, representatives, vicarious agents and third parties whom the organizer uses in connection with the implementation of the event or with whom it is contractually associated for this purpose.

4.3 The organizer assumes no liability for health risks of visitors in connection with participation in events. Participation is at one's own risk and peril. The organizer is not liable for injuries caused by other participants or outside third parties.

4.4 The organizer assumes no liability for objects stored by the visitor; the liability of the organizer due to gross negligence in selection remains unaffected.

4.5 Every visitor must have health and liability insurance, children and young people through their legal guardians. The conclusion of further insurances is at the discretion of the visitor.

1.2 The contractual partner within the meaning of these GTC is the person who books participation in a workshop with the organizer for himself and/or third persons (participants).

1.3 Participants in the sense of these GTC are all third persons who - without being contractual partners - are entitled to participate.

1.4 Visitors in the sense of these GTC are contractual partners and/or participants individually or together.

1.5 The GTC are subject to occasional changes in content. They are part of the contract between the organizer and the contractual partner in the version valid at the time of registration.

1.6 All declarations by a contractual partner vis-à-vis the event organizer shall be made in writing to EXPERIMINTA gGmbH, Hamburger Allee 22-24, 60486 Frankfurt, Germany, via workshops@experiminta.de.

2. Conditions of Participation

2.1 Depending on the type of event, a minimum age must be met in order to be eligible to participate. If a maximum age is specified, this must not be exceeded in order to be entitled to participate.

2.2 All organizational measures to be observed by the visitors shall be announced by the organizer to the contracting party in due time before the start of the respective event. The announcement shall be made either on the website of the organizer, by e-mail to the contractual partner or directly on site on the day of the respective event.

2.3 For the duration of the workshop, the legal guardians transfer the supervisory duties and rights to the organizer, which in turn may transfer them to its employees. The instructions of the organizer and his staff must be followed without fail. In the event of any infringement that may disrupt the proper course of the event or endanger the safety of the other visitors, the organizer is entitled to exclude the visitor in question from the event at any time. There is no right to a refund of the paid amount.

2.4 If a visitor becomes ill or injured during the event, the participant or his/her legal guardians authorize the provider to take all necessary steps and actions for safe, appropriate treatment. If any costs are incurred by the provider, the participant or his/her legal guardians agree to reimburse the provider immediately.

 

3. Registration - Participation fee - Terms of payment - Cancellation

3.1 By registering for a workshop, the contractual partner offers to conclude a contract with the organizer. Registration for a workshop shall be made via an online form provided. It is also made for all participants listed in the registration, for whose contractual obligations the registrant is liable as for his own obligations. Only after a written confirmation of the registration by the organizer, the visitor is bindingly registered for the event. By registering, the Visitor accepts the General Terms and Conditions of the Organizer.

3.2 For the order via the online booking form applies:

3.2.1 The Contractual Partner may submit the offer to conclude a contract for participation in the Workshop via the online booking form provided on the website of the Organizer. He can fill out this form on the website www.experiminta.de/en/workshops. In doing so, the Contractual Partner, after having entered his order data in the form, submits a legally binding contractual offer with regard to the selected offer and the associated services by clicking the button "Anmeldung absenden" which concludes the booking process.
However, the offer to conclude the contract by the contractual partner can only be made by him if he accepts the inclusion of these GTC in the contract and confirms this with a corresponding click. This process takes place before clicking the button "Anmeldung absenden" which concludes the booking process.
The booking process can only be completed in this way.

3.2.2 The organizer can accept the offer of the contractual partner according to section 3.2.1,
- by sending the contract partner an order confirmation in text form (fax or e-mail) within 7 calendar days of receipt of the offer, whereby the receipt of the order confirmation by the contract partner is decisive, or
- by requesting payment from the contract partner after the offer has been submitted.
If the organizer does not accept the contract partner's offer within 7 calendar days, this shall be deemed to be a rejection of the offer with the consequence that the contract partner shall no longer be bound by its declaration of intent.

3.2.3 Prior to the binding submission of the offer via the online booking form, the contracting party may continuously correct its entries using the usual keyboard and mouse functions. Before clicking the button "Anmeldung absenden", the contract partner also has the option of deleting entries as well as the option to cancel the booking process altogether.

3.2.4 The contract is concluded in German. This page is just a translation of the German General Terms and Conditions of EXPERIMINTA gGmbH. In case of doubt, the German version applies.

3.3 The respective participation fee includes the applicable statutory value-added tax and is charged by the organizer exclusively by invoice. It shall be paid by the contractual partner within the period stated on the respective invoice to the account of the organizer stated on the invoice. By registering, the contracting party agrees to electronic invoicing in PDF format. Visitors who have not paid the participation fee in time before the event may be excluded from participation.

3.4 Booking processing and contacting usually take place via e-mail and automated booking processing. The contractual partner must ensure that the e-mail address provided by him for booking processing is correct so that e-mails sent by the organizer can be received at this address. In particular, when using SPAM filters, the contract partner must ensure that all e-mails sent by the organizer or third parties commissioned by the organizer to process the booking can be delivered.

3.5 The contractual partner may withdraw from the workshop at any time. The withdrawal can only be declared in writing to the address mentioned under point 1.6. If the Contractual Partner withdraws from the contract or does not take up the offer, the Provider may demand lump-sum withdrawal costs in accordance with Section 651 i (2) of the German Civil Code (BGB) as reasonable compensation for precautions taken and for its expenses. The amount of the cancellation costs for canceled workshops depends on the receipt of the cancellation. Cancellations must always be made in writing (e-mail or mail). These flat-rate cancellation costs are per registered visitor:

  • Up to 2 weeks before the start of the event: free of charge
  • from 2 weeks before the start of the event: 100% of the registration fee
  • in case of unexcused absence: 100% of the participant fee

If the event is cancelled prematurely due to various reasons (such as illness, family celebration, injury), no costs can be refunded.

 

4. Exclusion of liability

4.1 Should the organizer be obliged to make changes to the implementation of the event or to cancel it due to force majeure or corresponding official orders or for safety reasons, the contractual partner shall have no claim to reimbursement of the participation fee. The organizer reserves the right to cancel individual events at short notice if the number of participants is too low. Claims for damages beyond the refund of the participation fee shall not arise in this case.

4.2 The organizer shall not be liable for property damage or financial loss unless such damage or loss is caused by gross negligence or intent on the part of the organizer. Excluded from this limitation of liability are damages based on the culpable violation of a contractual main performance obligation of the organizer as well as for culpably caused personal injuries (injuries to life, body or health of a visitor). The aforementioned limitations of liability also extend to the personal liability for damages of employees, representatives, vicarious agents and third parties whom the organizer uses in connection with the implementation of the event or with whom it is contractually associated for this purpose.

4.3 The organizer assumes no liability for health risks of visitors in connection with participation in events. The contractual partner shall be obliged to inform the provider of any health impairments and/or the necessity of any medication at the time of registration. Participation is at the visitor's own risk and peril. The organizer is not liable for injuries caused by other visitors or outside third parties.

4.4 The organizer assumes no liability for objects stored by the visitor; the liability of the organizer due to gross negligence of selection remains unaffected.

4.5 Each visitor must have health and liability insurance, children and young people through their legal guardians. The conclusion of further insurances is at the discretion of the visitor.

1.2 The contractual partner within the meaning of these GTC is the person who books participation in a vacation camp for himself and/or third persons (participants) with the organizer.

1.3 Participants in the sense of these GTC are all third persons who - without being a contractual partner - are entitled to participate.

1.4 Visitors in the sense of these GTC are contractual partners and/or participants individually or together.

1.5 The GTC are subject to occasional changes in content. They are part of the contract between the organizer and the contractual partner in the version valid at the time of registration.

In the event of any infringement that may disrupt the proper course of the event or endanger the safety of the other visitors, the organizer is entitled to exclude the visitor in question from the event at any time. There is no right to a refund of the paid amount.

2.4 If a Visitor becomes ill or injured during the Event, the Participant or his/her legal guardians authorize the Provider to take all necessary steps and actions for safe, appropriate treatment. If any costs are incurred by the Provider, the Participant or his/her legal guardians agree to reimburse the Provider immediately.

 

3. Registration - Participation fee - Terms of payment - Cancellation

3.1 By registering for a summer camp, the contractual partner offers to conclude a contract with the organizer. The registration for a summer camp takes place via an online form provided. It is also made for all participants listed in the registration, for whose contractual obligations the registrant is liable as for his own obligations. Only after a written confirmation of the registration by the organizer, the visitor is bindingly registered for the event. By registering, the Visitor accepts the General Terms and Conditions of the Organizer.

3.2 For the order via the online booking form applies:

3.2.1 The contractual partner can submit the offer to conclude a contract for participation in the vacation camp via the online booking form provided on the website of the organizer. The contractual partner can fill out this form on the website www.experiminta.de/en/holiday-camps. In doing so, the contractual partner, after entering his order data in the form, submits a legally binding contractual offer with regard to the selected offer and the associated services by clicking the button "Anmeldung absenden" which concludes the booking process.
However, the offer to conclude the contract by the contractual partner can only be made by him if he accepts the inclusion of these GTC in the contract and confirms this with a corresponding click. This process takes place before clicking the button "Anmeldung absenden" which concludes the booking process.
The booking process can only be completed in this way.

3.2.2 The organizer can accept the offer of the contractual partner according to section 3.2.1,
- by sending the contract partner an order confirmation in text form (fax or e-mail) within 7 calendar days of receipt of the offer, whereby the receipt of the order confirmation by the contract partner is decisive, or
- by requesting payment from the contract partner after the offer has been submitted.
If the organizer does not accept the contract partner's offer within 7 calendar days, this shall be deemed to be a rejection of the offer with the consequence that the contract partner shall no longer be bound by its declaration of intent.

3.2.3 Prior to the binding submission of the offer via the online booking form, the contracting party may continuously correct its entries using the usual keyboard and mouse functions. Before clicking the button "Anmeldung absenden", the contract partner also has the option of deleting entries as well as the option to cancel the booking process altogether.

3.2.4 The contract is concluded in German. This page is just a translation of the German General Terms and Conditions of EXPERIMINTA gGmbH. In case of doubt, the German version applies.

3.3 The respective participation fee includes the applicable statutory value-added tax and is charged by the organizer exclusively by invoice. It shall be paid by the contractual partner within the period stated on the respective invoice to the account of the organizer stated on the invoice. By registering, the contracting party agrees to electronic invoicing in PDF format. Visitors who have not paid the participation fee in time before the event may be excluded from participation.

3.4 Booking processing and contacting usually take place via e-mail and automated booking processing. The contractual partner must ensure that the e-mail address provided by him for booking processing is correct so that e-mails sent by the organizer can be received at this address. In particular, when using SPAM filters, the contract partner must ensure that all e-mails sent by the organizer or third parties commissioned by the organizer to process the booking can be delivered.

3.5 The contractual partner can withdraw from the vacation camp at any time. The withdrawal can only be declared in writing to the address mentioned under point 1.6. If the contractual partner withdraws from the contract or does not take up the offer, the provider can demand lump-sum withdrawal costs in accordance with § 651 i paragraph 2 BGB (German Civil Code) as reasonable compensation for arrangements made and for its expenses. The amount of the cancellation costs for canceled summer camps depends on the receipt of the cancellation. Cancellations must always be made in writing (email or mail). These flat-rate cancellation fees are per registered visitor:

  • Up to 4 weeks before the start of the event: free of charge
  • from 4 weeks before the start of the event: 50% of the registration fee
  • from 7 days before the start of the event: 100% of the participant fee
  • in case of unexcused absence: 100% of the participant fee

Cancellation fees are waived if a medical certificate is presented. The medical certificate must be received no later than 1 week after the written cancellation, otherwise the above-mentioned cancellation fees will apply. If the event is cancelled prematurely due to various reasons (such as: illness, vacation, family celebration, injury), no costs can be refunded.

 

4. Exclusion of liability

4.1 Should the organizer be obliged to make changes in the execution of the event or to cancel it due to force majeure or corresponding official orders or for safety reasons, the contractual partner shall not be entitled to a refund of the participation fee. The organizer reserves the right to cancel individual events at short notice if the number of participants is too low. Claims for damages beyond the refund of the participation fee shall not arise in this case.

4.2 The organizer shall not be liable for property damage or financial loss unless such damage or loss is caused by gross negligence or intent on the part of the organizer. Excluded from this limitation of liability are damages based on the culpable violation of a contractual main performance obligation of the organizer as well as for culpably caused personal injuries (injuries to life, body or health of a visitor). The aforementioned limitations of liability also extend to the personal liability for damages of employees, representatives, vicarious agents and third parties whom the organizer uses in connection with the implementation of the event or with whom it is contractually associated for this purpose.

4.3 The organizer assumes no liability for health risks of visitors in connection with participation in events. The contractual partner shall be obliged to inform the provider of any health impairments and/or the necessity of any medication at the time of registration. Participation is at the visitor's own risk and peril. The organizer is not liable for injuries caused by other visitors or outside third parties.

4.4 The organizer assumes no liability for objects stored by the visitor; the liability of the organizer due to gross negligence of selection remains unaffected.

4.5 Each visitor must have health and liability insurance, children and young people through their legal guardians. The conclusion of further insurances is at the discretion of the visitor.

 

5. Photo and film rights

By registering for a holiday camp, the visitor and his legal representatives agree that photos, film recordings or other audiovisual media services, which are created within the scope of the booked event by the organizer, his cooperation partners or their executing persons (e.g. supervisor, contact person) may be distributed and published by the organizer and its partners without restriction and without any claim to remuneration in radio, television, print and online media, internet, social networks, books and photomechanical reproductions, and this without restriction of the spatial, temporal or content-related area of use and, above all, also for purposes of the organizer's own or third party advertising, for merchandising purposes, for press releases, PR, advertising and commercial purposes.
